PracticeMine

Terms

Terms of use

Effective September 19, 2026.

These terms cover this website and, for practices that subscribe, the PracticeMine service. A practice's written agreement with us governs its subscription. Where that agreement and these terms differ, the agreement wins.

Who we are and what these terms cover

PracticeMine is provided by OMS3 LLC, doing business as Practice Metrix, of Plymouth Meeting, Pennsylvania. In these terms, "we" means OMS3 LLC. "The service" means the PracticeMine web app at app.practicemine.com, its administration pages and PracticeMine for Excel.

By using this website you accept the terms in the section about this website. By signing in to the service you accept all of these terms on your own behalf and, where you are acting for a practice or organization, on its behalf as well.

Practices subscribe to the service under a written agreement with us, which may include a Business Associate Agreement. That agreement governs the subscription. These terms apply alongside it, and where the two differ, the written agreement controls.

This website

The pages at www.practicemine.com describe PracticeMine. They are for information, and we may change or remove them at any time. Nothing on this site is an offer to provide the service on particular terms; those come from the subscription agreement.

PracticeMine and Practice Metrix are trademarks of OMS3 LLC. The names of practice-management systems and other products mentioned on this site belong to their owners, who are not connected with us and do not endorse PracticeMine.

You may view and print pages from this site for your own use. Please do not copy its text, illustrations or design for any other purpose without asking us.

The PracticeMine service

The service is available only to practices and organizations that subscribe, and only through accounts that we or the subscriber's administrators create. Using it any other way is not permitted.

Subject to these terms and the subscription agreement, we grant the subscriber and its authorized users a non-exclusive, non-transferable right to use the service, during the subscription, for the subscriber's own practice management. No other rights are granted.

Accounts

  • An account is for one person. Do not share your sign-in, and do not let anyone else use your account.
  • You are responsible for what is done with your account. Tell us at once if you think it has been used without your permission.
  • Keep your email address current. We send sign-in codes and reset codes to it, and it is how we reach you about your account.
  • A practice's or organization's administrators decide which accounts may open which practices. If you leave a practice, its administrators should remove your access, and we may do so at their request.

Acceptable use

When using the service, you agree not to:

  • open, or try to open, a practice you are not authorized to see, or use a practice's data for any purpose other than the operation of that practice;
  • copy, reproduce, publish or distribute the service's measure definitions, report templates or software, or use them to build or improve a competing product;
  • reverse engineer, decompile or otherwise try to obtain the source code of the service or the add-in, except to the extent the law allows regardless of this term;
  • use automated means to extract data from the service beyond the features it provides for that purpose;
  • interfere with the service's operation or security, probe it for weaknesses, or place an unreasonable load on it;
  • use the service in a way that breaks the law, including HIPAA and the privacy laws that apply to your practice.

We may suspend or end an account's access if we reasonably believe these terms are being broken, and we will tell the subscriber's administrators when we do.

Your data and our software

Practice data belongs to the practice. The records the service reads from a practice-management system, and the numbers it derives from them, remain the practice's property. We use them only to provide the service, as described in our privacy policy and the subscription agreement. Reports, pages and value groups that a user creates in the service belong to the subscriber.

The service belongs to us. The software, the design of the service, the measure definitions and their explanations, the standard reports and the documentation are ours or our licensors' and are protected by copyright and other laws. Nothing in these terms transfers them.

If you send us suggestions about the service, we may use them without any obligation to you.

PracticeMine for Excel

PracticeMine for Excel is part of the service and is licensed on the same basis. You may install it on the devices you use for your work with a subscribing practice. It runs inside Microsoft Excel, and your use of Excel is governed by your agreement with Microsoft, not by us.

A workbook that contains PracticeMine tables contains a copy of practice data. The practice is responsible for where that workbook goes and who can open it, as it is for any other copy of its records.

The numbers are information, not advice

PracticeMine reports what your practice-management system recorded, organized by the definitions the service carries. It does not give financial, tax, legal, accounting or clinical advice, and it is not a substitute for your books of account or for the system of record. Definitions differ from those your accountant, your software vendor or your own reports may use, and the service tells you what each measure means so you can compare. Check any figure against the source records before you rely on it for a decision, a filing or a payment.

Availability and changes

We work to keep the service available, but it may be interrupted for maintenance, for updates or for reasons outside our control. Any commitment about availability is in the subscription agreement. We may change the service, add or retire features, and update the add-in, and we will tell subscribers about changes that matter to them.

Disclaimer and limitation of liability

Except as the subscription agreement provides, this website and the service are provided as they are and as available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the service will be uninterrupted or error free, or that the numbers it reports will meet a particular need.

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue or lost data, arising from this website or the service. Our total liability for any claim arising from the service is limited to the amount the subscriber paid us for the service in the twelve months before the claim, unless the subscription agreement says otherwise. Some jurisdictions do not allow some of these limits, so some may not apply to you.

Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Any dispute that the subscription agreement does not otherwise provide for will be brought in the state or federal courts sitting in Montgomery County, Pennsylvania, and you consent to their jurisdiction.

Changes to these terms

We may update these terms. We will post the new version here with a new effective date, and for changes that affect the service we will tell subscribers in advance. Continuing to use the website or the service after a change means you accept the new terms.
